User Agreement
Introduction
This E-Assessment platform was created and is maintained by Prepona Sistemas de Testagem e Avaliação S.A. (Prepona) and serves to primarily deliver Internet-Based Tests (IBT) and Computer-Based Tests (CBT) on behalf of a variety of third-party certifying bodies, corporations, government agencies and academic institutions (Certifying Bodies). We also work in conjunction with different partners who use our platform, its various web-based modules and stand-alone systems to manage candidate registration, payments, test booking, test result and digital certificate production, as well as the day-to-day operations of different test-centre networks (Operational Partners). As well as Certifying Bodies and Operational Partners, our platform may also be used by third-party providers of test content (Content Partners). In this User Agreement we refer to all these partners as Principal Partners and you may find their names and/or trademarks/logos on our homepage (www.prepona.com) along with the names of the certification exams we deliver on behalf of these Certifying Bodies.
BY CLICKING ON “I AGREE”, YOU STATE THAT YOU HAVE READ, ARE AWARE OF AND AGREE TO ALL THE TERMS AND CONDITIONS SET OUT IN THIS USER AGREEMENT AND PREPONA’S POLICIES, WHICH ARE INTEGRAL PARTS OF THIS AGREEMENT. WHAT YOU AGREE TO WHEN ACCEPTING THE TERMS AND CONDITIONS OF THIS USER AGREEMENT AND THE POLICIES CONTAINED HEREIN This User Agreement sets out the following Terms and Conditions governing access to and use of this E-Assessment Platform. Purpose of Platform, plus Requirements for Access and Use The purpose of this platform is to allow those people, who wish to take an assessment (Test Takers) or professional certification exam (Candidates), to access and use the platform. To do so, you will be asked – and in some cases required – to provide personally identifying information. If, during registration, you do not provide information as required by Prepona or by our Principal Partners, your access will be denied. This platform is also designed to be used by our Principal Partners and people they allow to access and use either the Platform, its web-based Modules or stand-alone systems. For a description of such users (Principal Partner Users, or Users), please see our Privacy Policy below. These Terms and Conditions also apply to Principal Partner Users. Provision of Information for Registration and Acceptance of Legal Responsibility Any information you provide must be truthful. By agreeing to the Terms and Conditions of this User Agreement you accept full legal responsibility for providing such information in a truthful manner and you further agree to hold Prepona free of any liability whatsoever for verifying such information as provided by you. You further agree that, in order to be able to access and use this platform, you are at least 16 years of age on registration. For any exceptions to this minimum age limit, please consult our Privacy Policy below. Protection of Content, System and Personal Information Just as Prepona undertakes to safeguard any information you provide (please refer to our Privacy Policy below) by agreeing to the Terms and Conditions of this User Agreement, you hereby promise to:
Privacy Statement Prepona recognises the importance of protecting the privacy of personal information provided by all Users. For details regarding how Prepona treats this information, please see our Privacy Policy below. The following applies specifically to certification exam Candidates and professional or academic Test Takers: By agreeing to these Terms and Conditions, you also agree to abide by any terms and conditions set out by Certifying Bodies or Exam Boards regarding their certification exams or academic or professional assessments. These specific terms and conditions may be found in this Platform and at the beginning of your exam. The following applies specifically to Users who work for or with, or who have been appointed by Prepona or any of our Principal Partners: Prepona only registers for access and use of this Platform its own officers, employees and agents. It also only registers system and web-based module Administrators for our Principal Partners. From that point on Principal Partners control and manage registration and access of all Users related to them. Prepona accepts no liability whatsoever for whom our Principal Partners choose to register as Users. Therefore, on being registered Prepona assumes that you have been properly vetted and approved by the Principal Partner concerned and that you have agreed to their specific terms and conditions as Users of this Platform. Both Prepona and our Principal Partners reserve the right to suspend or deny access to any User this Platform at any time and for whatever reason. As a Principal Partner User, legal action may be taken against you if you are found to be in breach of the Terms and Conditions of this User Agreement or of any agreement you may have with the Principal Partner who allowed you to access and use this Platform. Notice and Disclaimer: All Users of this Platform do so at their sole risk and without any representations, warranties, or assurances by Prepona regarding the veracity of the information provided by them or by any other Users, including our Principal Partners. Prepona also makes no representations, warranties, or assurances that the information Users provide will be transmitted immediately or correctly to our servers or will be processed in the amount of time they may require to meet their needs. By using this Platform, all Users hereby acknowledge and agree that they will not have or assert any claims of any kind or character against Prepona or its officers, employees or agents regarding their use of this Platform. Please remember Prepona does not control the privacy policies or practices of these websites and accepts no responsibility whatever for the content or practices of such websites.
Retention of Information Prepona will retain your information for as long as is necessary to fulfil any of the uses identified in this privacy policy or to comply with applicable legal, regulatory, or court orders. It may therefore be important to share information with those who have a legitimate reason to use it, including courts of law and government agencies. Security and Confidentiality We believe in protecting the all personal information provided by you through the use of reasonable administrative, physical and technical safeguards. We use secure sockets layer (SSL) transmission, as well as agreed protocols for establishing a secure connection for transmitting this information as required by any of our Principal Partners of courts of law. We also have security protocols and measures in place to protect your personal information from unauthorized access, alteration, and unlawful disclosure. The following applies specifically to certification exam Candidates and professional or academic Test Takers: Information Prepona Collects on Registration and during the Post-Test Survey: Personal information that can identify you – such as your name and address, official identification number or social security number, and photographs even – may be either required or requested on registration, or when answering a post-test survey as normally determined by our Principal Partners. If, during registration, you do not provide the information as required, you will not be able to proceed. Use of Your Personally Identifying Information either by Prepona or Principal Partners This information may be used to: The following applies specifically to Users who work for or with, or who have been appointed by, Prepona or any of our Principal Partners: Prepona and Principal Partner Users include, but are not limited to Such personally identifying information given by you during registration will be used for the same purposes as for Candidates and Test Takers and given the same protection. However, our Principal Partners will also have immediate access to this information for the purposes of effective and efficient management. Request to permanently remove identifying information If you wish, you may ask Prepona to remove all personally identifying information from our platform. If you do so, we will immediately comply with your request and inform you by replying to you request as sent to us by email. Please remember, though, such action will mean you will no longer be able to access any part of our platform, including accessing your exam results and digital certificates. If you wish to ask us to remove all your personally identifying information, please send your request to info@prepona.com. Children's Privacy Our platform is intended for use by people over the age of 16. It is not intended to be used by children or teenagers under the age of 16, unless such age restriction is waived by one of our Principal Partners. If you are under the age of 16, please do not use this platform unless there is such a waiver for the certification exam or assessment you wish to register for. COOKIES POLICY Use of Cookies Policy Our platform uses very few cookies and normally does so for convenience sake, such as remembering the language you have chosen as your preferred language for using our platform. When you access our platform, certain non-personally identifying information is automatically logged. This information may include your operating system, screen settings, web browser software, and referring website. This data is used for system improvement and administration, security, statistical analysis purposes, and business purposes in general. TRADEMARK AND COPYRIGHT POLICY Trademarks No use of any of the trademarks appearing anywhere in this Platform, its web-based Modules or stand-alone systems, or in the exams or assessments delivered by this Platform, is permitted without express written consent from either Prepona or the Principal Partner concerned. For permission to use any of Prepona’s trademarks, please contact us at info@prepona.com. For permission to use any trademark belonging to any of our Principal Partners, please contact them after consulting the correct means of doing so on their respective homepages or sites. Copyright All content in this Platform is copyrighted and is the intellectual property belonging either to Prepona or its Principal Partners. No material may be distributed, downloaded, modified, reused, reproduced, reposted, retransmitted, disseminated, sold, published, broadcast, circulated, or otherwise used except as expressly stated either in such materials or in this notice without the express written permission of either Prepona or the Principal Partner concerned.
